O R D E R

This writ petition has been filed for issuance of a Writ of Mandamus to direct the first respondent to dispose of the appeal dated 29.04.2024 filed by the petitioner against the order of the 2nd respondent in Pro.No.3988/2024 dated 04.03.2024 with a time frame on merits and in accordance with law and till then not to recover any money from the pay of the petitioner.

2. In the affidavit filed in support of the writ petition, it had been contended that the petitioner had been initially appointed as Junior Assistant on 16.02.2000 and subsequently promoted as Assistant on 2/6

06.09.2007 and as Superintendent on 30.09.2016. The petitioner had been working in the office of the District Forest Officer as Superintendent in Tiruvannamalai Forest Division with effect from 19.11.2019. A charge memo has been issued to the petitioner and consequent to the same, after completing disciplinary proceedings, an order of punishment of stoppage of increment for one year without cumulative effect had been passed by the 2nd respondent on 04.03.2024. The petitioner had filed an appeal before the first respondent on 29.04.2024. By this writ petition the petitioner seeks disposal of the said appeal.

3. Heard both sides and perused the materials available on record.

4. In view of the above, a direction is issued to the first respondent to follow the procedure as enunciated by law and dispose of the appeal within a period of six weeks from the date of receipt of a copy of the order. The petitioner is also at liberty to forward a copy of the order of the learned single Judge in W.P.No.2380 of 2024 which writ petition had 3/6

been filed by a co-delinquent who was similarly placed wherein the learned Single Judge on examining the explanation given had thought it fit to quash the punishment imposed. The petitioner may also forward a copy of this order to the first respondent who may also consider the same.

5. With the above direction, the writ petition is disposed of. No costs.
