Common Prayer: Criminal Original Petitions are filed under Section 482 of Criminal Procedure Code, pleased to call for the records in Crime Nos.15 of 2024 & 61 of 2023 on the file of the 1st respondent police and quash the same.

Kumar, Sr.C for Mr.Arvind Javakar For R1 in both cases : Mr.S.Udayakumar Government Advocate(Crl.Side) COMMON ORDER The complaint and counter complaint been registered by CCB, Chennai based on the complaint given by M/s.IK Jewellers against Chandiran and vice versa regarding sale of gold involves to the tune of 11,000 kgs. The investigation in both the cases are pending due to interference of this Court in the quash petition. As far as investigation in Crime No.61 of 2023 is stayed.

After hearing the learned Senior Counsel representing either side, it was initially on the line of settling the matter amicably by returning 3.700 kgs gold by the accused involved in Crime No.15 of 2/4
2024 to the defacto complainant I.Jayanthilal, but there is yet another dispute regarding non payment of Rs.6,50,00,000/- which is the subject matter of Crime No.61 of 2023.

In the light of the above fact, this Court is of the view that the Investigating Officer shall conduct the investigation in this matter and complete the investigation based on the material collected. Therefore, the interim order granted earlier on 26.02.2024 in Crl.M.P.No.3167 of 2024 in Crl.O.P.No.4300 of 2024 stands vacated. The Investigating Officer in both the cases shall complete the investigation within a period of two months. If the parties arrives at some settlement, report the same to the Investigating Officer and that will be taken into account and appropriate order will be passed by the Investigating Officer.

In view of the above, these Criminal Original Petitions are disposed of. Consequently, the connected Criminal Miscellaneous Petitions are closed.
