Writ of Mandamus has been instituted seeking for a direction to the 3rd respondent/ Revenue Divisional Officer, Erode, to conduct an enquiry and disposal of the appeal filed by the petitioner on 13.10.2020, challenging the order passed by the Tahsildar dated 17.09.2019.

2. The application came to be filed in the year 2020 and about 5 1⁄2 years have lapsed. This Court will not direct the authorities to dispose of the application out of turn, unless an urgency is established by a party approaching the competent authority. Routine direction to dispose of the representation would do no service to the cause of justice. However, in cases where the petitions were kept pending for long time by the authorities, it would be necessary for the Courts to intervene and issue direction to dispose of the same. Even under such circumstances, the urgency raised by the petitioner is also to be considered by the authority, while treating the petition as urgent, since many number of similar petitions may be pending before the authority

concerned.

3. Taking note of the facts and circumstances, the 3rd respondent is directed to dispose of the petitioner's application dated 13.10.2020 as expeditiously as possible, by affording an opportunity to the parties concerned.
