Application No.871 of 2021 in C.S.D.No.22891 of 2021 R.PONGIAPPAN,J.

This application has been filed to grant leave to institute the above suit before this Court with respect to portion of the schedule mentioned properties in Item Nos.3 to 17 situated outside the jurisdiction of this Court.

2. Learned counsel appearing for the applicant would submit that the applicants/plaintiffs herein filed the suit against the respondents/defendants praying for the relief of partition. He would further submit that both the plaintiffs and the defendants are residing outside the jurisdiction of this Court and further, except Item Nos.3 to 17, other Item Nos.1 and 2 of the schedule mentioned properties are situated within the jurisdiction of this Court. Moreover, the cause of action has also arisen within the jurisdiction of this Court.

msv that two of the schedule mentioned properties are situated within the jurisdiction of this Court, this application is allowed.

4. Registry is directed to number the civil suit if it is otherwise in order.
