PRAYER: Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus, directing the respondents to disburse the leave encashment benefits to the petitioner which he was entitled for the period of 08/2018 and 08/2019 with interest at the rate of 6% per annum from the said date of entitlement to till the date of actual disbursement.

ORDER

With the consent of both the parties, this Writ Petition is taken up for final disposal at the stage of admission itself.

2. The petitioner claims for payment of the surrender leave salary for the period of 08/2018 and 08/2019 amounting to a sum of Rs.29,688/- and Rs.31,396/- respectively, together with interest.

3. When the petitioner herein had earlier sought for his dues, for which he is entitled to, the respondents, in their proceedings dated 27.08.2022, had admitted that the aforesaid amount was due and that as soon as the amount is sanctioned by the Government, they would pay the same to the petitioner. In view of the admitted liability, the petitioner would be entitled for receiving the same, together with interest.

4. In the light of the above observations and findings, there shall be a direction to the respondents to pass appropriate orders on the 2/4

petitioner's representation dated 16.11.2022, by disbursing the amounts of Rs.29,688/- and Rs.31,396/-, together with interest at the rate of 4% from the date of his superannuation till the date of actual payment. Such orders shall be passed atleast within a period of four weeks from the date of receipt of a copy of this order.
