PRAYER: This criminal original petition has been filed under Section 528 of BNSS to relax the condition and permit the petitioner herein to leave India to Saudi Arabia in Crl.O.P.No.23220 of 2024 vide order dated 23.09.2024.

ORDER

This petition has been filed to relax the condition and permit the petitioner herein to leave India to Saudi Arabia in Crl.O.P.No.23220 of 2024 vide order dated 23.09.2024.

2.Heard both sides.

3.This Court, while granting bail to the petitioner, had imposed the following condition:

" 6(c). The petitioner shall not leave India without the previous permission of the Court."

4.The petitioner seeks relaxation of the said condition since he has secured a job in Saudi Arabia. This Court is of the view that the said condition cannot be totally relaxed. However, the petitioner is at liberty to move the Trial Court for seeking permission to leave. The petitioner shall furnish the details of departure and arrival and also the address of the place Page No.2 of 4

of his residence at Saudi Arabia and his Aadhar number, before the Trial Court. On such particulars being furnished, the Trial Court shall consider the said request, on its merits.

5.In view of the above, this Criminal Miscellaneous Petition is disposed of.
