Cont P No.1973 of 2017 Cont P No.1973 of 2017 N.ANAND VENKATESH.,J Purusant to the earlier orders passed by this Court on 17.03.2023, the 3rd respondent has filed a calculation memo. The learned Additional Advocate General took through this Court to the memo of calculation and submitted that even after the filing of the modification petition during October 2022, subsequent payments have been made from November 2022 to March 2022. If the amounts that were paid is given credit, the total balance amount to be paid works out to a sum of Rs.67,27,64,670.07/- [Sixty Seven Crores twenty seven lakhs sixty four thousand and six seventy only]. The learned Additional Advocate General submitted that this amount will be paid in 15 installments. 2.
When the writ petition was disposed of by order dated 02.11.2021, this Court in order to safeguard the interest of the petitioner, impleaded the respondents 5 and 6 in the writ petition and directed them to waive the penal interest payable by the petitioner for the period during which the corporation was directed to repay back the amount, due and payable at that point of time. If the request made by the Corporation seeking for the payment of the balance amount in 15 instalments, is to be considered, the similar request to the respondents 5 and 6 in the writ petition to waive the penal interest must be considered. Only if that is done, the interest of the petitioner and the corporation can be safeguarded.

The learned Additional Advocate General submitted that he will take instructions from the impleaded respondents 5 and 6 in the writ petition and report before this Court.
