Mr. R. Muralidharan Order (Order of the Court was made by R.Suresh Kumar J.) Heard the learned counsel for both sides. Some reasons have been stated for the restoration of the CMA Nos.999 of 2024 and 4802 of 2019, which were dismissed for non prosecution on 04.12.2024.

2. On hearing both sides, we are of the view that if at all these petitions are to be accepted, it is only on the basis of the costs to be paid, as some prejudice has already caused to the respondent.
3. In that view of the matter, on condition that in each of the petition the petitioner shall pay a sum of Rs.5000/- (Rupees Five Thousand only) as costs to the respondent through his counsel within a period of two weeks from the date of receipt of a copy of this order, the above CMPs are ordered, failing which, the petitions shall stand dismissed automatically without any further reference to this Court.
