ORDER

This writ petition has been filed for issue of writ of mandamus directing the 1st and 2nd respondents to grant additional EB service connection to the shops constructed by the petitioner in the first floor of the property based on the online application submitted by the petitioner on 22.10.2024 for two connections and on 19.12.2024 for yet another connection. 2.The specific case of the petitioner is that he is a lessee under the 3rd respondent temple based on the lease agreement entered into with the trustee of

3/7 the temple. The further case of the petitioner is that he was already given a service connection for the ground floor. Three shops were constructed in the first floor and application was submitted for service connections by paying the necessary charges. Since the same was not considered, the present writ petition has been filed before this Court.

3.The learned Standing Counsel appearing on behalf of the 1st and 2nd respondents submitted that the applications were returned and the charges were also refunded. Therefore, the petitioner has to necessarily make a fresh application by paying the charges. The 2nd respondent will decide as to whether No Objection Certificate is required or in the alternative, to receive an indemnity bond from the petitioner to grant service connection. 4.The learned Government Advocate appearing on behalf of the 3rd respondent submitted that the petitioner is an encroacher and he is not entitled for any electricity service connection.

4/7 5.The learned counsel for the petitioner submitted that the petitioner is not aware of the earlier applications returned by the 2nd respondent and that even if fresh application is made, the earlier charges paid by the petitioner must be given due credit.

6.This Court has carefully considered the submissions made on either side and also the materials available on record. 7.The applications submitted by the petitioner is said to have been returned by the 2nd respondent. In view of the same, the petitioner has to submit a fresh application for the service connection. If the charges paid by the petitioner has already been refunded to the petitioner, the petitioner has to necessarily pay the charges afresh along with the applications. If the charges have not been refunded, due credit can be given to the charges paid by the petitioner when the earlier applications were submitted. On receipt of the application from the petitioner, the 2nd respondent shall deal with the same and

5/7 do the needful, within a period of four weeks from the date of receipt of fresh application from the petitioner.
