Prayer: Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus directing the second respondent to pass appropriate order on the enquiry report submitted by the fourth respondent pertaining to the proceedings in Na.Ka.No.2560/2014 Pa.Sa.2(2) dated 19.6.2014 on the file of 3rd respondent and to take appropriate action against the respondents 5 to 7 in giving sanction for prosecution against them. By consent, this writ petition is taken up for final disposal.

2. The petitioner claims that he was an employee of Madras Fertilizers Ltd., Company and had retired from service during June, 2010. During August 2010, the petitioner made a search to purchase a house to his son, who is in United States of America and one Mr.Sankarkumar has informed the petitioner that the fifth respondent was making arrangements to sell his property of land and house situated at Plot No.3, Old Door No.18A, New Door No.22, Perumal Koil Street, Madavaram, Chennai-60, by public auction and the petitioner participated in the auction and became the successful bidder.

The petitioner requested to hand over the property prior to the registration of the sale deed, but it was evaded and subsequently, he came to know that fraud has been played upon by fabricating the documents and in this regard, he also lodged a complaint on the file of the Inspector of Police (Crimes), F2 Police Station, Egmore, Chennai on 20.03.2014 against Thirunavukkarasu, Poongodi, respondents 5 to 7 and their staff and Mr.Sankarkumar and also made a further representation seeking action and since he has not been favoured with any response, came forward with this writ petition.

3. Heard Mr.D.Venkatachalam, learned Government Advocate, who accepts notice for the respondents 1 to 3 and on instructions would submit that the third respondent is contemplating to initiate criminal action against the sixth respondent and other officials.

4. This Court, taking into consideration the limited scope of prayer sought for by the petitioner and without entering upon the merits of the petitioner's representation, directs the second respondent, either by himself or through the third respondent, to take appropriate action on the representation submitted by the petitioner in accordance with law within a period of six weeks from the date of receipt of a copy of this order and communicate the decision to the petitioner.
