ORDER

This application has been filed seeking to implead the petitioners as party respondents in the main writ petition.

2.The petitioners claim that they are in possession of a piece of land and a building in the property which is the subject matter of the impugned proceedings. They claim that they were also parties to the impugned proceedings. Learned Senior Counsel appearing for the petitioner drew the attention of this Court to the impugned proceedings to point out that the petitioners were parties to the impugned proceedings. 3.However, according to them, the rival claimant who is claiming patta for the entire extent of land has not impleaded the petitioners as party respondents in the writ petition. Since the petitioners claim that they are the necessary parties which is also supported by the impugned proceedings where they had participated, necessarily they have to be impleaded as party respondents in the main writ petition.

4.A copy of the impleading petition has also served on the learned counsel for the writ petitioner. Though he seeks time to get instructions with regard to the prayer sought for in this petition, this Court after giving due consideration to the fact that the petitioners were parties to the impugned proceedings, this Court is of the considered view that the petitioners have to be heard in this writ petition before final orders are passed in this writ petition.

5.Accordingly this writ miscellaneous petition is allowed as prayed for by impleading the petitioners as respondents 5 to 9 in this writ petition. 6.The newly impleaded respondents are directed to file their counter on the next hearing date.

7.The Registry is directed to carryout the necessary amendment in the main writ petition. Post the matter for filing counter in the main writ petition on 18.03.2026.
