Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying for issuance of Writ of Certiorarified Mandamus to call for the records pertaining to the savings bank account of the petitioner as reflected in the statement of account provided by the State Bank of India Regional Business Office Puducherry being the savings account No.10583483067 with the 4th respondent dated 20.01.2011 bearing Ref.No.RBO/PDY/16/5673, in which the 1st respondent had remitted the family pension of the petitioner from the period 01.01.2006 up-to-date, and quash any action of seizure, attachment or sequestration at the instance of the 4th respondent thereon direct the 4th respondent to release the same to the petitioner together with interest thereon and consequently direct 1st respondent to transfer the pension account bearing T.No.108206 on the file of the 1st respondent to the 2nd respondent.

O R D E R

The present Writ Petition has been filed for issuance of Writ of Certiorarified Mandamus to call for the records pertaining to the savings bank account of the petitioner as reflected in the statement of account provided by the State Bank of India Regional Business Office Puducherry being the savings account No.10583483067 with the 4th respondent dated 20.01.2011 bearing Ref.No.RBO/PDY/16/5673, in which the 1st respondent had remitted the family pension of the petitioner from the period 01.01.2006 up-to-date, and quash any action of seizure, attachment or sequestration at the instance of the 4th respondent thereon direct the 4th respondent to release the same to the petitioner together with interest thereon and consequently direct 1st respondent to transfer the pension account bearing T.No.108206 on the file of the 1st respondent to the 2nd respondent.

2. The learned Government Advocate filed a Counter Affidavit in the present Writ Petition, stating that on request of the Writ Petitioner, the pension payment has been transferred to District Treasury, Theni, in office Rc.No.7529/08/F2, dated 03.05.2011. Since the petitioner's request has been complied with by the respondents, nothing survives for adjudication in this Writ Petition.

3. Recording the aforesaid submissions stated in the Counter Affidavit, this Writ Petition is dismissed. There shall be no order as to costs. Consequently, connected miscellaneous petition is closed.
