Writ petition is filed under Article 226 of the Constitution of India for issuance of a Writ of Certiorarified Mandamus, to call for the records relating to the order passed by the fifth respondent dated 12.04.2018 in his Office Memorandum No.E37023/CISF/ChPT/Ad-III/HE-OSE/2018/95 and quash the same and to direct the respondents to entertain the application dated 17.03.2018 and permit petitioner to pay fees appeal for the APLAWCET-2018 examination to be held on 19.04.2018 and to complete the Higher Education (L.L.B. 3 years course) by granting 28 months study leave along with six months other kind of leave and thus render justice. This Writ Petition has been filed seeking to quash the impugned proceedings and for a consequential relief to permit him to appear for APLAWCET-2018 examination and to complete the higher education by granting 28 months study leave along with 6 months other kind of leave, in the interest of justice.
2. During the course of hearing, the learned Standing Counsel appearing for the respondents has placed a copy of the proceedings No. E-31014/SD/VRS/S N RAO GORLA/SZ-II/2024/434, dated 06.02.2024 issued by the third respondent.
3. On perusal of the same, it appears that the petitioner was relieved from service on Voluntary Retirement with effect from 31.01.2024 (Afternoon). 2/4
4. Learned Standing Counsel submits that in view of the fact that the petitioner was already relieved from service on Voluntary Retirement, nothing survives in this writ petition for adjudication and requested to close the writ petition.
5. Learned counsel for the petitioner submits that he could not get any instructions from his client, as he is not responding.
6. In view of the facts stated above, in our considered view, nothing survives in this writ petition for further adjudication and accordingly, it is liable to be dismissed as infructuous.
7. Accordingly, this Writ Petition is dismissed as infructuous.
8. Consequently, connected miscellaneous petition is closed. There shall be no order as to costs.
