Prayer : Writ Petition filed under Article 226 of Constitution of India praying for the issuance of a Writ of Certiorarified Mandamus, calling for the records of the Impugned order (Per) Rc.No.D2/Q/434/9546/2017, dated 01.11.2023, quash the same and further directing the first respondent to pay anomaly for junior get more pay, 1. Anamaly pay, 2. Interest amount for the petitioner's delayed payment of junior get more and encashment amount with 6% interest per annum till the date of payment.

ORDER

This writ petition has been filed challenging the order passed by the fifth respondent dated 01.11.2023, thereby rejected the request made by the petitioner seeking direction to the first respondent to pay anomaly for junior get more pay.

2. Heard the learned counsel on either side and perused the materials available on record.

3. The petitioner was appointed as Police Constable on 10.06.1977. After completion of his service, he had retired from service on 31.03.2010 as Special Sub-Inspector of Police. The petitioner submitted a representation seeking to sort out the pay anomaly on par with his juniors. It was rejected on the ground

that the salary of the junior most person, viz., Kuppan was wrongly fixed and the respondents are taking steps to revise the salary to sort out the pay anomaly between the petitioner and the junior most person viz., Kuppan, the Special Sub-Inspector of Police.

4. Therefore, the request made by the petitioner was not considered and the fifth respondent had rightly rejected the request made by the petitioner and this writ petition is devoid of merits and is liable to be dismissed.

5. Accordingly, this writ petition is dismissed. Consequently, connected Miscellaneous petition is closed. There shall be no order as to costs. 27.02.2024 Internet: Yes Index : Yes/No Speaking/Non Speaking order mn
