..Respondent(s) Writ petition filed under Article 226 of Constitution of India for the issuance of writ of Mandamus directing the respondents 2 and 3 to consider the petitioner's representation dated 15.04.2025 conduct a fair proper and impartial enquiry and consequently, issue patta in favour of the petitioner in respect of the properties comprised in Survey Nos. 144/5, 144/6 and 145/1 situated at Kurunji Nagar, Kottavadi Post, Pethanaickenpalayam Taluk, Salem District, notwithstanding the classification of Survey No. 145/1 as Sudukaatu, further directing the respondents 1 to 3 to pay just and lawful compensation to the petitioner in accordance with law, within a time frame fixed by this Court and pass orders.

ORDER

This writ petition has been filed seeking for a direction to the respondents 2 & 3 to issue patta in favour of the petitioner in respect of the properties more fully described in the prayer to the writ petition, based on the petitioner's representation dated 15.04.2025.

According to the petitioner, erroneously the properties have been classified as Sudukaadu, Odai and Anadheenam. The petitioner had given a representation dated 15.04.2025 to the respondents 2 and 3 requesting them to issue patta in the name of the petitioner for the properties more fully described in the prayer to the writ petition. Since the said representation has not been considered till date, the petitioner has filed this writ petition. 3.

Mr.R.P.Murugan Raja, learned Government Advocate, accepts notice on behalf of the respondents. Since no adverse order is passed against the respondents 4 to 6, notice to them is dispensed with. 4.

As seen from the documents filed by the petitioner along with this writ petition, the 2nd respondent has already initiated proceedings based on the petitioner's representation dated 15.09.2025. 5.

No prejudice would be caused to the respondents, if the petitioner's representation as stated supra is considered on merits and in accordance with law, after hearing the objections of respondents 4 to 6 and any other third party, whom the 2nd respondent deems fit to enquire, within a time frame to be fixed by this Court.

This Court is not expressing any opinion on the merits of the petitioner's representation.

For the foregoing reasons, this Writ Petition is disposed of, by directing the 2nd respondent to pass final orders on merits and in accordance with law, on the petitioners representation, dated 15.09.2025 seeking for grant of patta in the name of the petitioner for the properties more fully described in the prayer to this writ petition, after giving due consideration to the supporting documents filed by the petitioner and after hearing the objections of respondents 4 to 6 and any other party, whom the 2nd respondent deems fit to enquire, within a period of twelve (12) weeks from the date of receipt of a copy of this order. No costs.
