2/7 PRAYER Writ Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus, directing the 3rd Respondent to comply the direction / order issued by the 2nd respondent in Na.Ka No.4443244 / 2023, dated 21.04.2023, and to submit report to the 2nd respondent in respect of petitioner's representation dated 24.03.2023 for exchange of poramboke lands in S. No. 255/3, 255/4, 260/2, 261/3, 261/4, 262/4, 262/5 and 260/5 measuring to an extent of 04.99 cents, out of acre 5.69.5 cnet situated at Guruparapalli village, Krishnagiri Taluk, with the patta lands owned by the petitioner in S. No.267/1, 268/1, 269/4A 269/4C and 269/4E, measuring to an extent of 08.07 cents, situated at Sennapalli village, Sulagiri Taluk within a reasonable time frame fixed by this Court.

ORDER

This writ petition has been filed for issue of writ of mandamus directing the 3 rd respondent to submit the report to the 2 nd respondent in order to enable the 2 nd respondent to deal with the representation made by the petitioner on

3/7 24.03.2023, wherein, the petitioner has sought for the exchange of patta lands to the lands which have been categorized as 'Poramboke'. 2.Heard Mr.S.Natarajan, learned counsel appearing on behalf of the petitioner and Mr.A.Selvendran, learned Special Government Pleader appearing on behalf of the respondents.

3.When the matter came up for hearing on 26.02.2025, this Court passed the following order:

Mr.A.Selvendran, learned Special Government Pleader, takes notice for respondents 1 to 4.

2. On going through the materials placed before this Court, this Court finds that the representation made by the petitioner for exchange of land was taken on file and the 2nd respondent has called for a report from the 3rd respondent through communication dated 21.04.2023. Thereafter, there is no progress and hence, the present writ petition has been filed before this Court.

3. The learned Special Government Pleader shall take

4/7 instructions on the further development in this case and report before this Court in order to enable this Court to pass final orders.

4. Post this writ petition under the caption "for orders" on 12.03.2025.

4.When the matter was taken up for hearing today, the learned Special Government Pleader on instructions submitted that the 3 rd respondent is yet to submit a report before the 2 nd respondent since the 3 rd respondent has forwarded the files to the Commissioner of Land Administration and based on the instructions of the Commissioner of Land Administration, the report will be placed before the 2 nd respondent.

5.Considering the materials placed before this Court and considering the submissions made on either side, there shall be a direction to the 2 nd and 3 rd respondents to take a final decision on the representation made by the petitioner seeking for exchange of lands, within a period of twelve weeks from the date of receipt of copy of this order.
