This Criminal Original Petition has been filed to direct the Judicial Magistrate, Chinnasalem, to dispose of C.M.P.No.1056 of 2025 within a stipulated period.
2. The petitioner, as a complainant, had filed a private complaint against ten persons under Section 223 BNSS for offences under Sections 61(2) r/w 3(5), 198, 201, 335, 337, 340(2) and 339 IPC. The complaint was kept pending before the Judicial Magistrate No.II, Kallakurichi. Thereafter, it was periodically adjourned. Subsequently, on the orders of the Principal District Judge, Kallakurichi dated 25.09.2025, the case was transferred from the file of the Judicial Magistrate No.II, Kallakurichi to the District Munsif Cum Judicial Magistrate, Chinnasalem and was posted for hearing on 29.12.2025. On that date, fresh summons were ordered to the accused, and the case was adjourned to 05.03.2026.
3. The learned counsel for the petitioner, on instructions, submits that process has been taken against the accused, but thereafter the case has not been properly adjudicated.
4. In view of the above, the District Munsif-Cum-Judicial Magistrate, Chinnasalem, is directed to take up the complaint of the petitioner in Crl.M.P.No.1056 of 2025 and proceed with the case without further delay. The Magistrate shall preferably take the complaint on file, if it is otherwise in order, comply with all requirements within a period of two months, and thereafter proceed with the case in accordance with law.
5. With the above observations, this Criminal Original Petition is disposed of.
