ORDER

The petitioner, who was arrested and remanded to judicial custody on 23.11.2025, for the alleged offence punishable under Sections 296(b), 115(2), 118(1), 351(2) of BNS, 2023 r/w. Section 7, 8 of POCSO Act, in Crime No.59 of 2025 on the file of the respondent police, seeks bail.

2. The allegation against the petitioner is that the petitioner is the step father of the victim child aged about three years and he joined with mother and demanded the child to call him as father. Since the child has not called him so, he started harassed her. It is further alleged that he has bitten all over the body of child including the private parts; while child was in the pre primary school the injuries were noted by the school administrator and immediately the message was forwarded to the grandmother of the victim and thereafter she came to the school and enquired about the incident. Thereafter, the accused threatened the grandmother. Hence the complaint has been lodged.

The learned counsel for the petitioner submitted investigation is completed and final report is also filed and the petitioner is ready to abide by any stringent condition that may be imposed by this Court. He further submitted that the petitioner is in custody from 23.11.2025. Hence, he prayed for grant of bail to the petitioner.

4. Learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that though final report is filed the case is not yet taken on file. He further submitted that this is the second bail petition and the earlier bail petition was dismissed by this Court on 29.01.2026 in Crl.O.P.No.1238 of 2026. Hence, he opposed for grant of bail to the petitioner.

5. Considering the fact that this is not only the case of penetrative assault and as recorded in the earlier order passed by this Court, the petitioner has caused severe injuries to the victim girl, if the petitioner is granted bail, there is likelihood of tampering of witnesses, hence, this court is not inclined to grant bail to the petitioner.
