O R D E R

This petition has been to direct the second respondent to take further action on the petitioner's complaint dated 16.09.2019 vide C.S.R.No.1567 of 2019.

2. Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondents.

3. The learned counsel for the petitioner has submitted that in the petitioner's house one Jayashree was working as maid servant and she has committed 243⁄4 sovereigns jewels and Rs.48,000/- (Rupees Forty Eight Thousand only) and hence the petitioner has lodged a complaint before the second respondent on 16.09.2019, but so far, no action has been taken on the said complaint.

Per contra, the learned Additional Public Prosecutor has submitted that after receipt of the petitioner's complaint, preliminary enquiry was conducted and an FIR in Crime No.120 of 2020 was registered on 26.02.2020 under Section 381 of IPC. He further submitted that the second respondent after registering the FIR, the second respondent is investigating the matter and further he prayed to dismiss the petition.

5. Considering the above said submissions, the learned Additional Public Prosecutor submitted that already an FIR has been registered based on the petitioner's complaint. Hence, this petition has become infructuous.

6. Accordingly this Criminal Original Petition is dismissed as infructuous.
