Despite service of notice and printing the names of respondents 1 to 5, 7 to 14, 17 and 18, there is no representation on behalf of those respondents.

2.Inso far as respondents 6, 15 and 16 are concerned, notices sent to those respondents have been returned with an endorsement "left". However, even these respondents were not present either in person or through counsel while dismissing the Original Petition for non-prosecution.

3.In such view of the matter, the delay of 202 days in filing the restoration application in O.P.No.330 of 2009 is condoned and this application is allowed.
