Defendant Prayer: This Civil Suit is filed under Order VII Rule 1 of the CPC read with Order IV Rule 1 of Original Side Rules, praying for a preliminary decree declaring the half share of the plaintiff in schedule of properties with all rights, interests, benefits, etc. accrued thereof and hand over separate possession of her half share by metes and bounds and measurements.

JUDGMENT

The suit had been filed seeking a preliminary decree declaring the half share of the plaintiff in schedule of properties with all rights, interests, benefits, etc. accrued thereof and hand over separate possession of her half share by metes and bounds and measurements.

2. By order dated 24.07.2024, this case has been referred to the Mediation and Conciliation Centre attached to High Court of Madras. Accordingly, both the parties appeared before the Mediation and Conciliation Centre, settlement has been arrived at and a settlement agreement has been filed duly signed by the plaintiff, defendant and their respective counsels.

3. In view of the above, the civil suit is decreed in terms of the settlement agreement. The settlement agreement shall form part of the decree. No order as to costs. Consequently, OA is closed. 17.10.2024 rgr 2/3
