In spite of service of notice to the respondent, they had neither entered appearance nor was present before this Court and hence, the matter was relegated to the learned Master for recording evidence. However, even when the evidence was recorded, there was no appearance on the side of the respondent. 2.

Even today when the matter is taken up there is no representation on the side of the respondent.

I have perused the materials available on record and the deposition of PW1 who had been examined on behalf of the applicant. A thorough perusal of the proof affidavit and also exhibits filed in support of the application through PW1 conclusively proves the claim of the applicant. 4.

In such event, the application as prayed for by the applicant is ordered and the respondent is directed to pay a sum of Rs.1,12,32,397.26 together with interest @ 12% per annum within a period of eight weeks from the date of receipt of a copy of this Order.
