The 2nd respondent remained exparte before the Tribunal. Hence, notice to the 2nd respondent is dispensed with.

2. Mr.R.Nalliyappan, learned counsel, who entered caveat, takes notice for the 1st respondent.

3. In the affidavit filed in support of the condone delay petition, it is asserted by the petitioner that due to the death of earlier counsel, there was some difficulty in getting certified copy of the award passed by the Tribunal and the same was obtained by engaging a new counsel.

4. In view of the said reason assigned in the affidavit filed in support of the petition, this Court is inclined to condone the delay of 1233 days in filing the appeal. Accordingly, C.M.P.No.3693 of 2025 is allowed.

5. The Registry is directed to number the civil miscellaneous appeal, if it is otherwise in order.

6. The Registry is further directed to print the name of Mr.R.Nalliyappan, as counsel for the 1st respondent in the cause-list at the time of listing the matter for admission.
