PONGIAPPAN CRIMINAL MISCELLANEOUS PETITION No.3271 of 2022 IN CRL OP.4353/2022 1 RAGUL [ PETITIONERS/ACCUSED ] 2 THIRUVENGADAM Vs STATE REP BY [ RESPONDENT ] THE INSPECTOR OF POLICE, C-4, SOMANGALAM POLICE STATION, KANCHEEPURAM DISTRICT (CRIME NO.28/2022) Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to modify condition imposed in Para 8(b) petitioners appear before the respondent police daily at 10.00 a.m. 15 days the order dated 22.02.2022 made in Crl.OP.No.4353 of 2022, by this Hon'ble Court and to pass such further or other orders as may deem fit and proper in the circumstances of the case and thus render justice.

Order : This petition coming on for orders upon perusing the petition and the filed in support thereof and upon hearing the arguments of M/S.P.CHANDRA SEKAR, Advocate for the petitioner and of M/S.LEONARD ARUL JOSEPH SELVAM, Govt. Advocate ( Crl. Side) on behalf of the Respondent the court made the following order:- This petition has been filed to modify the condition in Para 8(b) that "petitioners appear before the respondent police daily at 10.00 a.m. for a period of 15 days" imposed in Crl.O.P.No.4353 of 2022 dated 22.02.2022 by this Court.

2. Heard the learned counsel appearing for the petitioners.

3. It was represented that at the time of passing orders in Crl.O.P.No.4353 of 2022, this Court directed the petitioners to appear before the respondent police daily at 10.00 a.m. for a period of fifteen days and thereafter, as and when required for interrogation.

4. On the other hand, while at the time of registering the case against these petitioners, a counter case has also been registered against the defacto complainant, wherein, she was enlarged on bail with a condition to appear before the respondent police daily at 10.00 a.m.

5. It is the specific submission of the learned counsel for the petitioners that if the petitioners and their rival party appear before the respondent police in the same time, there may be a chance for further dispute between the petitioners and their rival party. Hence, the petitioners are before this Court with the above prayer.

6. The learned Government Advocate (Criminal Side) appearing for the respondent police submitted that the petitioners are complying with the conditions imposed by this Court without any deviation.

7. Taking into consideration of the fact that the submission made by the learned counsel for the petitioners is reasonable and also considering the submission made by the learned Government Advocate (Crl. Side) that the petitioners are complying with the conditions without any deviation, the order dated 22.02.2022 made in Crl.O.P.No.4353 of 2022 is modified to the effect that the petitioners shall report before the respondent police daily at 5.00 p.m., for a period of fifteen days. All other conditions remain unaltered.
