ORDER

This petition has been filed seeking to quash the FIR in Crime No.485 of 2018 pending on the file of the respondent Police.

2. This is one of the strange cases where the defacto complainant has approached this Court seeking to quash the FIR on the ground that he did not give any complaint to the respondent Police and the respondent Police themselves have registered an FIR in Cr.No.485 of 2018 as if the petitioner gave the complaint.

3. The learned Additional Public Prosecutor on instructions submitted that if the petitioner is disowning the complaint, he will not be called for an enquiry and he will not be shown as witness in the case. The respondent Police will proceed further with the investigation in Crime No.485 of 2018, since the case involves an offence under Section 304 A of IPC. https://hcservices.ecourts.gov.in/hcservices/

4.Recording the submissions made by the learned Additional Public Prosecutor, this Criminal Original Petition is disposed of.
