Learned counsel for the appellant would submit that the suit itself got decreed exparte and therefore, nothing survives for further adjudication. He has also made an endorsement to that effect in the Court bundle. The learned counsel for the respondent also admits the same.

Recording the submissions, the Civil Miscellaneous Appeal is dismissed as infructuous. However, it is open to the parties to work out their remedies in the manner known to law. No costs. Consequently, connected civil miscellaneous petition is closed.
