ORDER

This Writ Petition is filed seeking to quash the proceedings of the second respondent dated 17.10.2022 made in A.P. No. 187 of 2020.

2. The petitioner has filed the present Writ Petition challenging the impugned order, whereby the authority under the Industrial Dispute Act directed for the reinstatement of the first respondent.

3. An enquiry was initially conducted, and the first respondent was dismissed from service. Following the dismissal, the Management sought approval from the Special Joint Commissioner of Labour. However, after an enquiry, the Special Joint Commissioner of Labour, refused to grant approval and instead directed the Management to reinstate the first respondent.

4. The learned counsel for the Management submits that the Management is willing to take back the workmen without backwages, but with continuity of service.

5. Recording the said submission, the Writ Petition is disposed of with a direction to the petitioner to reinstate the first respondent without backwages, but with continuity of service, within a period of four weeks from the date of receipt of copy of this order. No costs. Consequently, connected miscellaneous petition is closed.
