K.Pushpa v. The Secretary To Government
WMP No.5542 of 2023 in WP No.6472 of 2022 S.S.SUNDAR, J.
AND SUNDER MOHAN, J.
[Order of the Court was made by S.S.SUNDAR, J.] It appears that the detenu, who is the convict prisoner, has obtained leave and the leave has been extended periodically. The last extension was by an order dated 09.06.2023 upto 12.12.2023.
2. It is seen from the medical report that the detenu/convict prisoner is bedridden and that he is under constant treatment. Therefore, the learned Additional Public Prosecutor has no objection. He even submitted that the respondents have recommended for premature release of the detenu/convict prisoner having regard to the peculiar medical conditions of the detenu.
3. In such circumstances, for the same reason for which the leave was extended on earlier occasion, now the leave is extended by three months from 12.12.2023 and this WMP stands ordered accordingly.
4. List the writ petition on 12.03.2024.
