O R D E R

The petitioner has come up with this writ petition seeking a direction to the respondent to grant notional promotion as Executive Engineer with effect from the date on which his immediate junior was promoted to that post and to settle the pension and retirement benefits on that footing.

2. Mr.M.Ganesan, learned counsel takes notice on behalf of the respondent. By consent of both parties, the writ petition is taken up for final disposal at the admission stage itself.

3. The relief sought for by the petitioner seeking mandamus will not lie, as the petitioner is aggrieved by the order dated 29.02.2012. Without challenging the same, the petitioner cannot seek for the present prayer. Whether there is a delay in questioning or not, will be decided in case the said order is questioned before this Court. The present case on hand, as https://hcservices.ecourts.gov.in/hcservices/

mandamus cannot be sought for, the writ petition is dismissed. No costs. Consequently, the connected miscellaneous petition is closed.
