ORDER

The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 5, 7(3) of Lotters Regulation Act 1998 and 318(4) of BNS (420 of IPC) in Crime No.16 of 2026, Seeks

anticipatory bail.

2. The allegations against the petitioner is that on 02.02.2026, during the routine checking respondent police found A1 and A2 selling fake lottery tickets. On enquiry, they confessed that the said ticket were purchased from the petitioner (A3) from other states and were being sole here at a higher price. Hence, the case has been registered.

3. The learned counsel for the petitioner submitted that the petitioner is innocent and falsely implicated in this case by the respondent police. He further submitted that only based on the confession statement of the co-accused, this petitioner has been arrayed as an accused, he undertakes to cooperate with the investigation and abide by any stringent condition that may be imposed by this Court. Hence, he seeks anticipatory bail to the petitioner.

The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution's case and on instruction submitted that 17 previous cases are pending against the petitioner and the investigation in this case is still progressing and she opposed for grant of anticipatory bail to the petitioner.

5. Considering the over tact levelled against this petitioner and the bad

antecedents of the petitioner who have several previous cases and there is likelihood of indulging in similar offences, I am not inclined to grant anticipatory bail to the petitioner.
