ORDER : The Court Made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offences under Sections 279, 336, IPC r/w 7(5), 20(2) Cigarette and Other Tobacco Products Act, 2003 in Crime No.698 of 2021 seeks anticipatory bail.

2. The Petitioner herein is the owner of the car bearing Registration No.TN 18 AM 3414 (TATA HEXN), is before this Court seeking anticipatory bail.

3. The learned Government Advocate submits that banned Tobacco products of worth Rs.1,00,000/- packed in 15 bags were transported in the vehicle owned by the petitioner. While transporting the tobacco products,the petitioner's car collided with the check post due to rash and negligence driving by the driver of the car. After the alleged occurrecne, the driver of the car fled from the scene.

4. Ms.Vidhya, Village Administrative Officer in Melvisharam Village went to the spot and and recovered all the Tobacco products scattered around the car and the same was handed over to the respondent police.

5. Considering the gravity of the case, this Court is not inclined to given anticipatory bail to the petitioner.

6. The Criminal Original Petition is dismissed. -sd/- 09/03/2022 This order, on being produced, be punctually observed and carried into execution by all concerned TRUE COPY Sub-Assistant Registrar (Statistics/C.S.) High Court, Madras - 600 104.
