Heard Ms.L.Parvin Banu, learned counsel appearing for the petitioner and Ms.P.Rajalakshmi, learned Government Advocate appearing for the respondent.
2.This Contempt Petition has been filed for willfully disobeying the Orders of this Court dated 26.11.2014. This Court by an order dated 11.02.2015 directed the learned
Special Government Pleader to accept notice and get instructions in the matter. Today, the learned Government Advocate has appeared and produced the order dated 02.02.2015 wherein the 1st respondent has rejected the petitioner's request.
3.The learned counsel appearing for the petitioner submitted that there is another teacher, Mr.Saravanakumar as B.T.Assistant (Maths) for the very same Santhapadugai Middle School in the same union is willing for mutual transfer.
4.Therefore, there shall be a direction to the petitioner to submit a representation to the District Elementary Educational Officer, Nagapattinam District, Nagapattinam, who is the 3rd respondent in the Writ Petition and the petitioner shall also enclose the consent letter of the other teacher Mr.Saravanakumar. On receipt of the same, the 3rd respondent in the writ petition, shall consider the petitioner's request. Though there may be a Government order stating that such transfer would be considered only during May, this Court is constrained to make such an observation because of the peculiar situation
and this direction need not be treated as a precedent. The said direction shall be complied with by the 3rd respondent in the Writ petition within a period of two weeks from the date of receipt of copy of this order. No costs. With the above direction, this contempt petition is disposed of. No costs.
