PRAYER:- Writ Petition filed under Article 226 of the Constitution of India, praying for the issuance of a writ of mandamus directing the 1st respondent to pass suitable orders for closing down the Ramachandra Matriculation Higher Secondary School at No.474, Kilpauk Garden Road, Kilpauk, Chennai - 600 010 as claimed in application dated 30.12.2020 submitted under Rule 20(1) of Tamil Nadu Recognised Private School (Regulations) Rules 1974 Form VIII in a time bound period.

The prayer of the petitioner is for a mandamus directing the first respondent, i.e., the Director of Matriculation Schools, to pass suitable orders closing down the petitioner school situated at 474, Kilpauk Garden Road, Kilpauk, Chennai - 600 010. In this regard, the petitioner has submitted an application dated 30.12.2020 in terms of Rule 20(1) of the Tamil Nadu Recognised Private School (Regulation) Rules, 1974.

Mr.D.Ravichander, learned Special Government Pleader, who accepts notice for the respondents would however bring to the notice of the Court that the aforesaid application of the petitioner has been returned to the school on 01.02.2021 as it has been filed before the wrong authority and the competent authority is the second respondent, the Chief Educational Officer.
3. Learned counsel for the petitioner has been supplied with a copy of communication dated 01.02.2021 and he would submit that the school will do the needful in this regard.
4. Thus, there is no necessity to keep this Writ Petition pending any further.
If an application is presented/re-presented along with all relevant/necessary documents within a period of one week from today by the petitioner, let the authorities do the needful and arrive at a conclusion within a period of eight (8) weeks from date of receipt of the application, after hearing the petitioner and any other party, that the authority may believe is necessary.
