2. An order dated 17.11.2022 made by Judicial Magistrate I, Alandur vide Crime No.304 of 2012 accepting a closure report and dropping the proceedings has been called in question in Crl.O.P (SR) No.5758 of 2023. To be noted, Crime No.304 of 2022 is the predicate offence qua w No.02 of 2012 dated 19.03.2012.

3. After some arguments, learned Special Public Prosecutor sought leave of this Court court to withdraw the captioned Crl.MP but made a plea to preserve all the rights and contentions of the petitioner to come up with a third party leave application. Learned Special Public Prosecutor has made an endorsement in the case file and a scanned reproduction of the same is as

In the light of the narrative thus far, captioned Crl.MP is disposed of as closed albeit preserving all the rights and contentions of the petitioner (including the contentions raised in the captioned Crl.MP) for coming up with a suitable petition.
