Respondents PRAYER: Writ Petition is filed under Article 226 of Constitution of India praying to issue Writ of Mandamus directing the 1st and 2nd respondents to appoint the petitioner on compassionate grounds in the place of the petitioner's father, late V.Gopinath without insisting on a "No Objection" from the 3rd respondent.

This Writ Petition has been filed for direction directing the respondents 1 & 2 to appoint the petitioner on compassionate ground in the place of his deceased father without insisting No Objection Certificate from the third respondent.

2. Heard Mr.S.Surya, learned counsel appearing for the petitioner, Ms.Nilani Clairen, learned counsel appearing for the respondents 1 & 2. Though notice has been served on the third respondent, there is no representation for the third respondent either in person or through counsel. Perused the materials available on record.

3. The petitioner's father got married in the year 1991 and the petitioner was born on 28.04.1993. The third respondent is her paternal grandfather. Her mother lived with her father for a short period and due to differences of opinion, they got separated. Her father was working as Stores Custodian in the office of the respondents 1 & 2. While he was in service, he died on 06.01.2009. The third respondent, being paternal grandfather of the petitioner, obtained legal heirship certificate and made claim before the second respondent in respect of 2/4

terminal benefits of the deceased father of the petitioner. Therefore, the petitioner submitted a representation before the first and second respondents not to pay any terminal benefits to him as well as seeking compassionate appointment on the demise of her father.

Considering the above facts and circumstances, the respondents 1 & 2 are directed to consider the request made by the petitioner for compassionate appointment and disburse the terminal benefits of her deceased father in accordance with law within a period of twelve weeks from the date of receipt of a copy of this order, if not already considered.

5. With the above direction, this Writ Petition is disposed of. There shall be no order as to costs.
