By consent, the main writ petition itself is taken up for final disposal.
2. The prayer in the writ petition is to issue a Writ of Mandamus, directing the respondents to consider the petitioner's representation dated 28.03.2016 and thereby direct the respondents to pay the monthly pension to the petitioner immediately, since the date of retirement is on 22.04.2010.
3. The case of the petitioner is that he was appointed as a peon in the respondent Indian Bank on 15.01.1985 and posted at Sivadhapuram Branch, Salem District. The petitioner rendered his service in the respondent Indian Bank with utmost care and devotion and he has been appreciated for his dedicated service in the Bank. Due to his continuous ill health, he was unable to continue his job. Hence, he submitted resignation to the respondent Bank and considering the same, he was relieved from duty on 22.04.2010. Subsequently, his retirement benefits were settled to him but he was not paid the monthly pension, even though he completed 25 years of service. In this regard, the petitioner
had made a representation to the respondents on 28.03.2016 seeking monthly pension. Since no action had been taken on the said representation, the petitioner is before this Court with this Writ Petition.
4. Considering the limited scope of the prayer sought for, without going into the merits of the matter, this Court directs the third respondent to consider the representation of the petitioner dated 28.03.2016 and pass appropriate orders on the same, on merits and in accordance with law, within a period of four weeks from the date of receipt of a copy of this order. No costs.
