The petitioner seeks relaxation in the conditions imposed by this Court vide order dated 06.07.2023 in Crl.M.P.No.1145 of 2023 in Crl.A.No.909 of 2022, that the petitioner shall appear and sign before the learned Chief Judicial Magistrate, Vellore District, Vellore, on every Monday and if Monday becomes a public holiday, on the first working day of the week at 10.30 am until further orders and that he shall stay at Vellore and shall not go to Cuddalore District without prior permission of the learned Chief Judicial Magistrate (CJM), Vellore.
2. The learned counsel for the petitioner submitted that the conditions imposed by this Court have been scrupulously followed by the petitioner herein and he is regularly reporting before the trial Court. However, in view of the conditions imposed by this Court to the effect that the petitioner shall appear and sign before the learned Chief Judicial Page No.1/4
Magistrate, Vellore District, Vellore, on every Monday until further orders and that he shall stay at Vellore, the petitioner is unable to attend his normal duties and thereby, is put to untold hardship and sufferings. Thus, the learned counsel prayed for relaxation of the aforesaid conditions imposed on the petitioner.
3. The learned Additional Public Prosecutor, on instructions, submitted that that the petitioner is regularly complying with the conditions imposed by this Court on 06.07.2023.
4. Considering the submissions made by the learned counsel for the petitioner, as well as the learned Additional Public Prosecutor and also the fact that the petitioner herein is regularly complying with the conditions imposed by this Court, we are inclined to modify the order in the following manner:- "(d) The petitioner shall appear and sign before the learned III Additional District and Sessions Judge, Cuddalore at Vridhachalam, on the first Page No.2/4
working day of every month at 10.30 am until further orders."
