Arbitration Application under Order XIV Rule 8 of Original Side Rules r/w Section 9(1)(ii)(a)(b)(c) & (e) of the Arbitration and Conciliation Act, 1996, praying to raise the prohibitory order dated 03.06.2025 made in Arbitration Application No.605 of 2025 whereby prohibiting the Garnishee from making payment of a sum of Rs.1,07,28,848/- or any amount to the respondents or to their men, agents, representatives or to anyone claiming on respondents behalf and further directing the Garnishee to deposit the sum of Rs.1,07,28,848/- or any amount to the credit of the above application. ORDER

This application has been filed under Section 9 of the Arbitration and Conciliation Act, 1996, seeking to raise the prohibitory order passed in Arbitration Application No.605 of 2025 dated 03.06.2025.

2. Learned counsel for applicant brought to the notice of this Court that subsequently, the loan amount was regularized and hence, the present application has been filed to raise the prohibitory order passed in Arbitration Application No.605 of 2025 dated 03.06.2025. Learned counsel further submitted that if, in case, the respondents again commit default, liberty must be granted to the applicant to approach this Court. 2/4

3. In the light of the above submission made, the prohibitory order made by this Court in Arbitration Application No.605 of 2025 dated 03.06.2025 is recalled/raised. If, in the event the respondent committing any default in future, it is left open to the applicant to approach this Court and seek necessary relief.
