O R D E R

This Criminal Original Petition has been filed seeking to quash the First Information Report in Crime No.578 of 2025, pending on the file of the first respondent Police.

Based on the complaint given by the de facto complainant/R2, a case in Crime No.578 of 2025, was registered for the offences under Sections 296(b) and 115(2) of the Bharatiya Nyaya Sanhita (BNS), 2023 and 4 of the Tamil Nadu Prohibition of Harassment of Women Act, 2002. 3.

Heard the learned counsel appearing for the petitioners and the learned Government Advocate (Crl.Side) for the first respondent. 4.

Learned counsel appearing for the petitioners would submit that the fact remains that the de facto complainant's husband had assaulted the petitioners, due to which, the petitioners had given a counter complaint, based on which, a case in Crime No.577 of 2025 has been registered by the respondent police and only as a counterblast, the de facto complainant, on the instigation of her husband, has given a false case against the petitioners. He would further submit that the respondent police, without conducting a proper enquiry, has registered the case.

Learned Government Advocate (Crl.Side) appearing for the first respondent would submit that it is a case of case and counter; the petitioners and the de facto complainant are neighbours; there are series of fights between the petitioner's family and the de facto complainant's family, resulting in the registration of case and a counter case. He would submit that the respondent police are conducting investigation in both cases in compliance of PSO 566 and will file final report.

Recording the submission made by the learned Government Advocate (Criminal Side), this Criminal Original Petition stands closed with a direction to the respondent police to file final report within 4 months from the date of receipt of a copy of this order. Consequently, the connected miscellaneous petition is closed.
