Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying to issue a Writ of Certiorarified Mandamus, calling for the records pertaining to the proceedings of the second respondent in respect of Sl.No.31 in Na.Ka.No.A3/514/2015 dated 1.6.2015 and quash the same and consequently direct the 1st and 2nd respondents to appoint the petitioner for the post of "Nutrition Meal Helper" in the Panchyat Union Middle School, Gandhi Nagar, Gudalur Taluk, Nilgiris District. This writ petition is filed challenging the proceedings of the second respondent dated 01.06.2015 whereby the third respondent was appointed to the post of "Nutrition Meal Helper" in the Panchyat Union Middle School, Gandhi Nagar, Gudalur Taluk, Nilgiris District. 2.

When the matter was posted for hearing on 21.12.2024, there was no representation on the side of the petitioner. Therefore, the matter was ordered to be posted under the caption "for dismissal". Even when the matter is listed today, there is no representation on the side of the petitioner either in-person or through her counsel.

Mrs.V.Yamuna Devi, learned Special Government Pleader for the respondents 1 and 2 by relying on the counter affidavit submitted that there were 3 applicants including the petitioner and all the applications were considered and only since the petitioner had crossed the age of 40 years and was overaged on the date of submission of the application and the third respondent was eligible, after completing the interview process, the third respondent was duly appointed to the said post. Therefore, the claim made by the petitioner challenging the appointment cannot be sustained. 2/4

Since the petitioner has not chosen to appear before this Court inspite of listing the writ petition under the caption "for dismissal", this Writ Petition is dismissed for non prosecution. Consequently, connected Miscellaneous Petitions are closed.

There shall be no order as to costs.
