ORDER

The present criminal original petition has been filed seeking a direction to the respondent herein to issue nontraceable certificate to the petitioner in respect of his vehicle bearing No.G.3.C7.0076713 Key No.1813 Book No.194235 forthwith.

2. It is the case of the petitioner that he had lodged a complaint before the respondent police on 29.7.2016 stating that his Yamaha Motor Cycle bearing No.G.3.C7.0076713 Key No.1813 Book No.194235 was found missing, which was parked in front of the verandah of his house. On the basis of the said complaint, the respondent police registered a case in Crime No.254 of 2016 for the offence under Section 379 I.P.C. on 8.8.2016. Thereafter, the respondent has neither taken any steps to trace out his vehicle nor to issue certificate for not tracing out the said vehicle. Today, when the matter was taken up for consideration, learned Additional Public Prosecutor submitted that the respondent police is still tracing the vehicle of the petitioner and if the vehicle is not traced out, then necessary certificate would be issued to the petitioner. Further, he sought for four weeks time for the respondent to trace the vehicle.

4. In view of said submission made by the learned Additional Public Prosecutor, the respondent police is directed to trace the vehicle of the petitioner and if the vehicle is not traced out, then, the respondent police is directed to issue nontraceable certificate to the petitioner. The said exercise has to be completed within a period of four weeks from the date of receipt of a copy of this order. The criminal original petition is disposed of accordingly.
