This writ petition has been filed seeking issuance of a writ of mandamus directing the second respondent to consider the representation made by the petitioner on 12.11.2023 and issue 'No Objection Certificate' to enable the petitioner to get the service connection from the fifth respondent.
2. Heard Mr.K.Seetharam, learned counsel for petitioner, Mr.G.Velu, learned Additional Government Pleader appearing for respondents 1 to 4, 6 & 7 and Mr.L.Jaivenkatesh, learned Standing Counsel appearing for fifth respondent.

It is seen from records that the application was submitted before the TANGEDCO in the year 2011 and from then on, the issue is pending and the petitioner was directed to get 'No Objection Certificate' from the second respondent. Since the second respondent did not give 'No Objection Certificate', the present writ petition has been filed before this Court.
4. In the considered view of this Court, the petitioner is seeking for service connection to the property, which has been categorised as a Adidravidar land. In such a scenario, the fifth respondent can consider getting an indemnity bond from the petitioner after ascertaining the fact as to whether the petitioner is in possession and enjoyment of the property. The application can be processed accordingly and ultimately, even if the service connection is given, the petitioner cannot assert any right over the property if ultimately proceedings are initiated against the petitioner for encroachment. This clarity will sufficiently take care of the grievance expressed by the petitioner and will also provide clarity to the TANGEDCO while dealing with the application seeking for service connection.
