Respondent/Complainant PRAYER : Criminal Original Petition filed under Section 439(1)(b) of Code of Criminal Procedure, to modify the order dated 13.05.2015 on the file of the learned Judicial Magistrate No.II, Walajahpet in Crl.M.P.No.629 of 2015 in respect of the condition requiring the petitioner to execute a bond for Rs.10,000/- with two sureties, out of them one to be person having residence in his permanent address and the second to be the person having residence in the area where he now resides.

O R D E R

The learned Judicial Magistrate No.II, Walajahpet, has granted bail to the petitioner by an order dated 13.05.2015 in Crl.M.P.No.629 of 2015. While granting bail, the learned Judicial Magistrate No.II, has imposed a condition directing the petitioner to execute a bond for Rs.10,000/- with two sureties, out of them one to be person having residence in his permanent address and the second to be the person having residence in the area where he now resides. Now the present petition is to modify the said condition.

2. The learned counsel for the petitioner submitted that as the petitioner is now residing in Chennai, he is unable to produce sureties as directed by the learned Judicial Magistrate No.II, Walajahpet.

3. Considering the above submissions, the order of the learned Judicial Magistrate No.II, Walajahpet in Crl.M.P.No.629 of 2015 dated 13.05.2015 is modified to the following effect : (i) that the petitioner is directed to execute a bond for Rs.10,000/- with two local sureties each for a likesum to the https://hcservices.ecourts.gov.in/hcservices/

satisfaction of the Judicial Magistrate No.II, Walajahpet. (ii) Except this modification, other conditions remain unaltered.

4. This Criminal Original Petition is disposed of accordingly.
