The case of the plaintiff/applicant is that the subject matter of the suit property, which is said to have been mortgaged in favour of the applicant, has been brought for auction at the instance of 4th respondent.

2. The learned counsel appearing for the plaintiff/applicant submits that the suit is filed for declaration, declaring the sale made as null and void. The sale along with confirmation followed by a certificate has taken place within the territorial jurisdiction of this Court. The 3rd respondent, who is the purchaser of the subject matter of the property, is residing outside the jurisdiction of this Court.

3. Considering the submissions made by the learned counsel for the applicant and taking note of the averments made in the plaint, leave is granted.
