ORDER : The Court Made the following order :- The petitioner, who apprehend arrest for the alleged offence under Section 420 and 406 of IPC, in Crime No.not known of 2021 on the file of the respondent police, seeks anticipatory bail.

2. Heard both sides.

3. The case of the prosecution is that the petitioner who is carrying on business under the name and style of M/s.Ayush Enterprise at Villivakkam, Chennai, had purchased goods from the defacto complainant and failed to pay the amount due to him. Hence, the complaint.

4. The learned counsel for the petitioner would submit that the petitioner did not commit any offence as alleged by the prosecution. Due to pandemic situation, his business has come to a standstill and one of the manufacturers have given this false complaint. 5. The learned Government Advocate would submit that the petitioner is a whole sale merchant and he bought goods from the defacto complainant and had failed to pay Rs.58 Lakhs to the defacto complainant. He further submitted that the petitioner has no previous case.

6. In view of the fact that the petitioner is due to pay a sum of Rs.58Lakhs, this Court is not inclined to grant anticipatory bail to the petitioner.
