The prayer in this petition is to set aside the order passed by the learned Judicial Magistrate No.IV, Vellore, Vellore District in Crl.M.P.No.1975 of 2011 in C.C.No.144 of 2010 dated 10.05.2011.

2.Heard the learned counsel for the petitioner. There is no representation for the respondent.

3.Since the alleged pronote is essential document, the same can be presented and marked before the trial court for consideration. Hence, the impugned order is set aside. The petitioner is permitted to mark the alleged document viz.promissory note before the trial court and the trial court is directed to dispose of the matter within a period of six weeks. The criminal original petition is ordered accordingly. Registry shall return the document to the trial court.
