Petition filed under Article 226 of the Constitution of India praying for issuance of Writ of Certiorarified Mandamus, calling for the records of the respondent in Na.Ka.No.073563/H4 (3)/2012 dated 06.09.2012 canceling the marks awarded to the petitioner in Chemistry examination conducted in March 2012 by the respondent herein and to quash the same and further direct the respondent herein to confirm the mark of 84 awarded to the petitioner as per the mark sheet issued to the petitioner by the respondent.

O R D E R

The relief sought for in the present writ petition is to call for the records of the respondent in Na.Ka.No.073563/H4(3)/ 2012 dated 06.09.2012 canceling the marks awarded to the petitioner in Chemistry examination conducted in March 2012 by the respondent herein and to quash the same and further direct the respondent herein to confirm the marks of 84 awarded to the petitioner as per the mark sheet issued to the petitioner by the respondent.

2. The marks of the petitioner awarded in the Chemistry examination conducted in March 2012 was set aside, on the ground that the petitioner committed mal-practice. From the counter affidavit filed by the respondent, it is evidently clear that the petitioner had adopted illegal procedure and accordingly the marks were canceled and therefore, this Court cannot set aside the views of the Educational Authorities, who seek discipline among the students. Hence, no such relief can be granted by this Court.

3. Accordingly, the writ petition stands dismissed. No costs.
