ORDER
The petitioner, who was arrested and remanded to judicial custody on 18.12.2025, for the alleged offence punishable under Sections 126(2), 118(1), 303(2) @ 310 of BNS in Crime No.181 of 2025 on the file of the respondent police, seeks bail.
2. The allegation against the petitioner is that the petitioner joined hands with other accused involved in attacking the de facto complainant with a knife and robbed a sum of Rs.2,75,000/-, hence the case has been registered.
3. The learned counsel for the petitioner submitted that the petitioner is only aged about 20 years and he has been falsely implicated in this case due to previous enmity and he was not involved in the offence and is ready to cooperate with the investigation. Hence, he prayed for grant of bail to the petitioner.
4. The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that there are five accused in this case and A1 and A2 alone were arrested. The petitioner is ranked as A2 and three other accused are still absconding and the remaining
amount is yet to be recovered and the investigation is pending. Hence, he opposed for grant of bail to the petitioner.
5. Considering the fact that only Rs.50,000/- have been recovered and it is a case of robbery and some more accused are yet to be arrested, this Court is not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
