ORDER

The petitioner, who was arrested and remanded to judicial custody on 19.01.2024 based on execution of NBW dated 03.03.2017 in S.C.No.04 of 2017 on the file of the Learned I Additional District & Sessions Judge, Coimbatore, registered for the offences punishable under Sections 302, 324 and 306 of IPC in Crime No.55 of 2016 on the file of the respondent police, seeks bail. 2.

The learned counsel appearing for the petitioner submitted that originally the petitioner was arrested and released on bail and was regularly appearing before the Trial Court for the case in S.C.No.04 of 2017 and due to his non-appearance before the Trial Court, when the case is posted for framing of charges on 03.03.2017, a NBW was issued as against the petitioner and subsequently, the petitioner was arrested on 19.01.2024. He further submitted that the petitioner is ready to abide by any conditions that may be imposed by this Court and sought for bail to the petitioner. 3.Earlier bail petition of the petitioner was dismissed on 23.09.2025 in Crl.O.P.No.26173 of 2025 on the following reasons: "4. Considering the facts of the case, the charges against the petitioner, the petitioner has absconded for more than six years and taking note of the fact that most of the witnesses in this case were examined and the trial process is pending at the stage of arguments, this Court is not inclined to grant bail to the petitioner at this stage."

The learned counsel for the petitioner submitted that though earlier PW1 was examined and however he was not turn back for cross examination and instead of several adjournments and opportunities given, hence, the trial is not progressing and sought bail to the petitioner. 5.I have gone through proceedings entered in the E-court services and also the submissions made on both sides, this Court is of the view that the petitioner is almost in incarceration for nearly 2 years hence the trial is not to be concluded as an exceptional cases, considering the same, the trial Court is directed to dispose of the trial within a period of two months.

6. With the above directions, this Criminal Original Petition is disposed of.
