This Criminal Original Petition is filed to direct the Special Court for Trial of Cases under SC/ST (Prevention of Atrocities) Act in Thiruvannamalai District to consider the bail petition to be filed by the Petitioners, on their surrender on the same day, on merits in connection with the case in Cr.No.49 of 2026 pending investigation on the file of the respondent police.

ORDER

The criminal original petition has been filed to direct the Special Court for Trial of Cases under SC/ST (Prevention of Atrocities) Act in Thiruvannamalai District to consider the bail petition to be filed by the Petitioners, on their surrender on the same day, on merits in connection with the case in Cr.No.49 of 2026 pending investigation on the file of the respondent police.

2. Heard the learned counsel appearing for the petitioner as well as the learned Additional Public Prosecutor appearing for the first and second respondents.

3. Considering the submissions made and upon perusal of the materials available on record, it is seen that the petitioners objected to the act of the defacto complainant's brother cutting a tree which was situated adjacent to the petitioner's land. This led to a quarrel between the parties, during which the petitioners allegedly abused and attacked the defacto complainant and his wife. It is further alleged that on the same day, i.e., 02.02.2026 at about 8.30 p.m., the petitioners along with some other persons criminally trespassed into the house of the defacto complainant and assaulted the defacto complainant and his family

members. They are also alleged to have abused them by using to their caste name and threatened the defacto complainant and his family. Subsequently, the injured persons viz., the defacto complainant and his family were admitted to the Government Hospital, Vellore, and a complaint was lodged in this regard. 4.In view of the above factual position, there shall be a direction to the the Special Judge for Trial of Cases under SC/ST (Prevention of Atrocities) Act in Thiruvannamalai District to consider the petitioners' bail application, preferably on the same day of his surrender, in connection with Crime No.49 of 2026 on the file of the second respondent Police and to pass appropriate orders in accordance with law, after affording due opportunity to the victim under Section 15-A of the SC/ST (PoA) Act, 1989. The petitioners shall surrender before the jurisdictional Court concerned within a period of fifteen days from the date of the receipt of a copy of this order.
